These Terms of Service (“Terms”) govern your access to and use of the websites, borrower portal, and related services offered by Texas Star Title & Loans (“Company,” “we,” or “us”). By creating an account, accessing the Services, or submitting an application, you agree to these Terms. If you do not agree, do not use the Services.

1. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to applicable federal law and any mandatory venue rules, you agree that courts located in Texas have exclusive jurisdiction over disputes arising from these Terms or the Services, and you consent to personal jurisdiction there.

2. Eligibility and accounts

You must provide accurate, current information and keep your account information up to date. You may not use the Services for unlawful purposes or in a way that interferes with other users or our systems.

3. Acceptable use

You agree not to:

  • Violate any law or regulation;
  • Attempt to gain unauthorized access to our systems, other users’ accounts, or data;
  • Upload malware, scrape or overload the Services, or circumvent security measures;
  • Use the Services to harass, threaten, or defraud any person;
  • Misrepresent your identity or affiliation; or
  • Use automated means to access the Services except as we expressly permit.

We may suspend or terminate access for conduct that we reasonably believe violates these Terms or creates risk.

4. Account security responsibilities

You are responsible for safeguarding access to your account, including your email and phone used for authentication, one-time codes, and any passwords or devices you use. You must:

  • Notify us promptly if you suspect unauthorized access;
  • Not share verification codes or sign-in links with anyone;
  • Use devices and networks you trust when accessing the Services; and
  • Log out and secure your device when using shared computers.

We will never ask you for your password, full Social Security Number, or verification codes via unsolicited email, text, or phone calls. Treat such requests as fraudulent.

5. Credit Access Business role

Company may act as a Credit Access Business. Loan approval, terms, and servicing may involve independent third-party lenders. Your loan agreement and lender disclosures control the credit relationship; these Terms govern your use of our Services.

6. Payments

All payment processing for card or other electronic payments is handled exclusively by third-party payment processors. Texas Star Title & Loans does not capture, transmit, or store full payment card data (such as full card numbers, CVV, or magnetic stripe data) on its own servers. When you make a payment, you are subject to the processor’s terms and privacy practices as well as any instructions we provide at the point of payment.

7. Intellectual property

The Services, including software, text, graphics, and branding, are owned by Company or its licensors. Except for the limited right to use the Services as offered, no rights are granted.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS AND APPLICABLE LAW, IN NO EVENT WILL COMPANY OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

10. Indemnity

You will defend, indemnify, and hold harmless Company and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services, except to the extent caused by our gross negligence or willful misconduct.

11. Changes

We may modify these Terms by posting an updated version. Material changes may require additional notice or consent where required by law. Continued use after the effective date may constitute acceptance.
