Electronic Communications and E-SIGN Consent

This Electronic Communications and E-SIGN Consent (“Consent”) explains how Texas Star Title & Loans (“we” or “us”) may provide disclosures, notices, agreements, and other communications to you electronically, and how you may withdraw consent. It is provided under the federal Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”), 15 U.S.C. § 7001 et seq., and consistent principles under applicable state law.
1. Scope of electronic communications
If you agree, we may deliver by electronic means (including email, SMS where you have opted in as applicable, and through our online portal) documents and communications related to your application, loan, account, servicing, collections, marketing (where permitted), and legal or regulatory notices.
2. Hardware and software requirements
To access, receive, and retain electronic records, you should have:
- A current version of a widely supported web browser (such as recent versions of Chrome, Safari, Firefox, or Edge);
- A device with internet access and an email account you regularly monitor;
- Sufficient storage or the ability to download and save PDF files; and
- Software capable of opening PDF documents (such as a current PDF reader).
We may update these requirements from time to time. If the requirements change materially, we will describe the new requirements when we notify you where practicable.
3. How to obtain paper copies
You may request a paper copy of any electronic communication we are required or willing to provide in paper form by contacting us using the contact information on our website or in your loan documents. We may charge a reasonable fee for paper copies where permitted by law. We will disclose any fee before you incur it when feasible.
4. Updating your contact information
You are responsible for keeping your email address and other contact information accurate. You may update certain information through the borrower portal or by contacting us.
5. Withdrawing electronic consent
You may withdraw your consent to receive electronic communications at any time, without penalty to any right or remedy to which you are entitled under law, by contacting us in writing (for example, by email or mail to the address we provide) and stating that you withdraw your electronic consent. Withdrawing consent may mean we cannot continue to service your account electronically and may affect how we communicate required notices; we will explain any alternatives available to you under applicable law, which may include receiving paper communications or limiting certain online services until alternative arrangements are made.
Withdrawal of consent does not affect the legal validity or enforceability of electronic records provided while consent was in effect, to the extent permitted by law.
6. Consent to electronic delivery
By checking the consent box in our portal or registration flow (or otherwise indicating agreement), you confirm that you have access to the hardware and software described above, that you agree to receive communications electronically, and that you may print or save PDFs for your records.
